How justice is swept under the rug in China
The Ministry of Justice recently issued a decision on the establishment of the lawyers oath system. This new oath requires lawyers to declare loyalty to the Chinese Communist Party (CCP), which has caused some controversy. In other countries and regions of the world, lawyers also make an oath before they can practice, however their oaths declare that they will abide by the law and the Constitution, as well as the interests of justice.
Analysts agree this measure further strengthens the CCP's control over lawyers. In recent years, the sector most engaged in human rights protection work has been lawyers. In the crackdown on dissidents last year, authorities arrested dozens of human rights lawyers without a formal charge. Public opinion is that this new system is to strengthen the management and control over lawyers.
Mainland China writer Chen Yongmiao said that this new policy is to achieve control. “Groups like the human rights lawyers have had a great impact on politics. The typical market-oriented lawyers will probably follow the terms of this new oath. Lawyers that participate in human rights activities such as by providing legal services to Falun Gong practitioners or other human rights causes, will certainly lose their license. The CCP wants to strengthen its political leadership and political control over lawyers.”
The director of China's Lawyers and Notary Bureau spoke to the media: “The oath embodies the political and professional orientation of lawyers that is within this legal system with Chinese characteristics."
Chen Yongmiao believes that if lawyers have to be loyal to the CCP, this will impose serious restrictions on them. The dissatisfaction with this provision was the reason Chen was not granted his lawyer’s license.
Chen Yongmiao continues, “If someone wanted to plead not guilty, authorities can ask the person's lawyer to give a guilty plea instead. There could be many restrictions placed on how a lawyer can plea. One example is this oath puts forth an unwritten rule that lawyers are not allowed to defend a Falun Gong practitioner. Lawyers are not allowed to get involved. If you do, it will not meet the clause of “loyalty to the CCP.”
Ye Ning, a rights lawyer in Washington DC, spoke on the topic. Ye asks, 'If loyalty is to be legally declared to serve the CCP, where would the objectivity of lawyers go? On one hand, the government talks about political reform. On the other hand, they are firmly keeping the legal system as a totalitarian one.”
With regard to these latest lawyersregulations, the public is in hot discussion. Most people share the opinion that this new oath has no practical benefits.
