The Defeat of Les Presses Chinoises’ Lawsuit against The Epoch Times Clearly Spells Out the Inevitable Fate of Agents of the Chinese Communist Regime

March 15, 2012 | By Zhong Yan

(Clearwisdom.net) On February 23, 2012, the Canadian Court of Appeals in Quebec dismissed Les Presses Chinoises owner Crescent Chau’s appeal of an earlier judgment against his defamation lawsuit regarding The Epoch Times. In a unanimous decision, the three Canadian Appeals Court judges upheld the ruling Justice Catherine Mandeville handed down at the Quebec Superior Court on April 29, 2010, when she originally dismissed Chau’s case. “The trial judge concluded that the articles specified are not an unfair attack to the reputation of the appellants [Chau and co.]. It is worth repeating that in those articles, the respondent [The Epoch Times] claims that the appellants are agents of the People’s Republic of China, and that they are funded by the latter to spread its ideology regarding Falun Gong,” reads the judgment.
The outcome of this case has four implications: First, it is perfectly legal for The Epoch Times to reveal the fact that Crescent Chau and his Les Presses Chinoisesacted as agents of the Chinese Communist regime. Second, sooner or later, the Chinese Communist regime’s tactic of funding overseas Chinese media and instigating them to attack Falun Gong on its behalf will be exposed to the public. Third, the regime’s attempt to utilize the Western legal system to silence people who speak the truth will only hurt itself in the end. Lastly, those who act as the regime’s agents out of material interests will eventually face moral and legal punishment.
In order to give readers a good idea of various aspects of this particular lawsuit, we compiled the following facts from articles published in The Epoch Times. Note, some paragraphs are direct quotations from The Epoch Times articles while others are paraphrased. For details, see:

Timeline of the Lawsuit
It all started in late 2001, when Crescent Chau began to publish four special editions of his Montreal-based newspaper Les Presses Chinoises, which usually numbered at most 4,000 copies per week in Montreal and Ottawa. Chau himself declared that he was on a personal “crusade” against Falun Gong and called on the Montreal Chinese community to denounce it.
In August 2006, Chau somehow drummed up the funds to print 100,000 copies of a special 32-page tabloid without a single advertisement and distributed it nationwide free of charge. These special editions had no advertisements or news, just articles denouncing and calling for the elimination of the Falun Gong meditation practice, which has been subject to violent suppression in China since 1999. The articles repeated the Chinese regime’s most malicious, unsubstantiated charges against Falun Gong practitioners—that they engage in bestiality, vampirism, murder, and suicide. These are exactly the same virulent fabrications state-run media in China have broadcast since the practice was outlawed in 1999—charges that multiple government bodies and rights groups say are propaganda, used to justify the repression.
The Epoch Times examined Chau and his business and wrote several articles detailing his actions in 2007. In one article titled, “Montreal Newspaper a Voice for the Chinese Regime” (see http://www.theepochtimes.com/news/7-7-6/57287.html for details), The Epoch Times interviewed Chen Yonglin, a former high-ranking Chinese diplomat, the first secretary at the Chinese consulate in Sydney, Australia, before he defected in 2005. Chen suggested Chau was working on behalf of the Chinese regime.
That same year, Chau sued The Epoch Times for libel, seeking nearly a quarter million dollars in damages. The case reached the Quebec Court of Appeals in November 2009. Justice Catherine Mandeville dismissed the case on April 29, 2010. “This is a case of the biter complaining about being bitten,” she said in her ruling, adding that it was fair to suggest that Chau was acting as an agent of Beijing. The Epoch Times articles expressed “legitimate concerns and constitute an opinion which is drawn from a factual premise and not made for the purpose of abusively attacking the reputation of Mr. Chau,” the court found.
Chau appealed to the Quebec Court of Appeal on April 29, 2010, requesting thatThe Epoch Times pay damages of 70,000 Canadian dollars, as well as cover all his legal costs. The Court of Appeals ruled on February 23, 2012 that there was no reason to believe an ordinary citizen would deem that Crescent Chau or his paper had been improperly defamed, stating that “In view of the overall context of this public debate, this Court concludes that the litigious statements express legitimate concerns and constitute an opinion which is drawn from a factual premise and not made for the purpose of abusively attacking the reputation of Mr. Chau.” The court also found, “The fact that the respondent refers to the appellants as agents promoting the ideas of a government cannot be considered defamatory in those circumstances. All the more, Chau has declared several times that he shares the ideas of China about the movement in question.”
The court also ruled that Chau should cover The Epoch Times’ defense costs.
The Chinese Regime’s Overseas Mouthpiece Fails to Silence People with Western Legal System
Canadian Security Intelligence Service (CSIS) agent Michel Juneau-Katsuya, who used to head up the agency’s Asia-Pacific desk, said lawsuits like the oneThe Epoch Times faced are a common strategy the Chinese regime uses to silence people who are writing about sensitive topics.
He commented, “Chinese intelligence services know the law, and they have been using the law to try and intimidate people. This is a form gagging lawsuit. They try to sue people and entangle them in lawsuits for a long period of time, knowing this will cost them a lot of money, to scare them not to write about them.” He also said, “We know one thing — that the vast majority of the Chinese media are actively controlled by the [Chinese] government.”
Chau’s attempt to silence The Epoch Times with his defamation lawsuit has failed. This outcome shows that Western society’s respect for free speech is based on facts, not defamation.
The Chinese Regime’s Ongoing Efforts to Infuse Overseas Chinese Media with Capital
Concerns over the Chinese regime’s ability to influence Canadian society and policy were brought out in April 2009 when former CSIS head Jim Judd broke with the policy of not naming countries and revealed that nearly half of CSIS’s counter-intelligence resources were being dedicated to Chinese spies in Canada.
Michel Juneau-Katsuya indicated that there are at least two dozen front organizations controlled by the Chinese regime operating in Canada. He also specifically cited a Chinese newspaper report, an article indicating that the Chinese Communist Party’s central committee had dedicated an additional $3 billion to the Foreign Affairs Department and United Work Department to “embellish” the Chinese regime and China abroad for the next fiscal year.
According to a Jamestown Foundation organization article entitled “How China’s Government Is Attempting To Control Chinese Media In America,” the Chinese regime uses the following tactics to influence overseas Chinese media:
“First is the attempt to directly control newspapers, television stations and radio stations through complete ownership or owning major shares. Second is the government’s use of economic ties to influence independent media who have business relations with China. This leverage has had major effects on the contents of broadcasting and publishing, effectively removing all material deemed “unfavorable” by the Chinese government. Third is the purchasing of broadcast time and advertising space (or more) from existing independent media. Closely related to this is the government’s providing of free, ready-to-go programming and contents. Fourth is the deployment of government personnel to work in independent media, achieving influence from within their ranks.”
No one has exact data on how much money the Chinese regime has provided overseas Chinese newspapers, radios and TV stations. Xu Jiatun, former head of the Xinhua Net in Hong Kong, once said he helped transfer 30 million dollars to a pro-Chinese regime newspaper published in the U.S. and Hong Kong.
Chen Yonglin, the former Chinese consul, provided a document from the Chinese consulate in Sydney to show the depth of the Chinese regime’s infiltration of the Western world. Dated February 7, 2001, and titled, “Special Anti-Falun Gong Working Group Division of Labour Table,” it lists the responsibilities for members of the anti-Falun Gong team, which included the heads of all sections at the consulate. For example, the head of the political affairs department was responsible for “recommending” anti-Falun Gong articles from state-run media in China for use in Chinese-language media overseas and writing anti-Falun Gong articles for publishing in Chinese-language media. The head of the culture department was charged with sending such articles to politicians and media.
Chen said, “It is clear that Les Presses Chinoises is cooperating with the Chinese embassy and consulate and has become the hatchet man and propaganda tool for the Chinese Communist Party here.” He added, “It is very likely that the printing costs were directly funded by the Chinese embassy and consulate. The contents seem to be mostly produced and provided by the CCP.”
Canada Does Not Tolerate Organizations Controlled by Foreign Governments
Michel Juneau-Katsuya said, “CSIS’s responsibility is to protect Canadians and the government of Canada. Any organizations perceived as acting on behalf of a foreign government to do political or other forms of interference is and will be investigated by CSIS.”
He continued, “We know one thing — the vast majority of Chinese media are actively controlled by the [Chinese] government.”
Chau’s efforts to demonize Falun Gong did not go unnoticed after he published the defamatory articles. Within four days of the “special edition” hitting the streets, the website for the Mainland China-based People’s Daily, the official newspaper of the Chinese Communist Party, published a report praising Chau.
Juneau-Katsuya also raised an alarm that such efforts may increase, owing to an increased budget for the Chinese regime’s United Front Work Department, which manages such efforts overseas. He commented, “The United Front Work Department has been extremely active in financially and logistically supporting many of the organizations of this nature as front organizations to promote Chinese interests and to spy on Canadians and Chinese abroad.”
“They have at their disposal a phenomenal amount of resources to use front organizations and people supporting their activities,” said Juneau-Katsuya.
He added, “Any organization that is used by a foreign entity to do such activities here is judged to be unacceptable.”

Persecution at Chongqing Women’s Forced Labor Camp

Persecution and Forced Labor at the Chongqing Women’s Forced Labor Camp

March 21, 2010 | By a correspondent in Chongqing
(Clearwisdom.net) Falun Gong practitioners are tortured at Chongqing Women’s Forced Labor Camp. They are also subjected to brainwashing and forced to do hard labor for the labor camp’s financial gain. The labor camp uses the following three stages to persecute practitioners and to force them to do slave labor.
Stage 1: Training and Discipline
As soon as a Falun Gong practitioner arrives at the labor camp, arrangements are made for drug addicts to monitor the practitioner around the clock. The practitioners are forced to stand and squat in military formation during the day and are forced to write a “thought report” at midnight. The schedule was changed between April and May 2009. Practitioners were forced to write a “thought report” before 11:00 p.m. and go to bed at 11:00 p.m. The drug addicts take turns monitoring the practitioners and the lights of all the cells must be kept on during sleep time. The so-called “transformed” practitioners are locked in cells on the second floor, and new inmates, as well as practitioners who refuse to be “transformed” are locked in cells together with the drug addicts on the third floor. The practitioners must have their back to the wall when sleeping at night. Practitioner Zhang Zhengying was beaten in January of this year by drug addict Shen Hong because she faced the wall while sleeping.
Under the instigation from the corrupt camp guards, the drug addicts beat and verbally abuse practitioners at will. Drug addicts Zhang Hui and Li Jing beat practitioner Ms. Hu Liangjie until she vomited because she refused to write a “thought report.” Ms. Hu, in her fifties, had been detained at the labor camp since May 2008. Drug addict Wang Haiyan often beat practitioners, and once beat practitioner Ms. Zhang Jie so hard that Ms. Zhang could not lift her arm. Drug addict Feng Xueshuang once abused practitioner Tang Shizhen by forcing her to stand-up and squat-down 400 times. Drug addict Li Fengqiang forced practitioner Yang Zhongqin to eat the notebook in which she had been forced to write the thought report during the period of “training and discipline.”
Falun Gong practitioners who refuse to be “transformed” are persecuted by being locked up in small confinement cells. In these small cells the practitioners are not allowed to sleep in beds, and have to sleep on the floor, or be brutally beaten. Sixty-nine-year-old practitioner Qiu Shengshu was once locked in a small cell.
Stage 2: Brainwashing
Every day, two or three “education helpers” (brainwashing assistants) force the Falun Gong practitioners to read books and other materials that slander Falun Gong. The practitioners are also forced to attend brainwashing sessions every day and write “thought reports” every night. After they have been subjected to brainwashing for a month, the practitioners are coerced to write the three statements.
The so-called “transformed” ones are then locked in cells on the second floor and sent to the workshops to do slave labor. They are subjected to brainwashing sessions for two hours every day and must write “thought reports” every night. They are subjected to brainwashing for one or two more months.
The practitioners who refuse to be “transformed” are subjected to further persecution by the labor camp.
Stage 3: Forced Labor
Products of forced labor:
Various candies are wrapped at the labor camp. The candies above are popular for wedding celebrations.
The labor camp subjects practitioners to forced labor. Camp guards send the younger practitioners to the rubber shop to make fittings for the Chongqing Changan Automobile. This workshop failed in December 2008 and then changed to making fittings for electrical wire installation.
The older practitioners are sent to the candy shop to wrap candies, and have to meet a high hourly quota. In December 2009, camp guards raised the quota again, adding one jin (1 jin = 1.1 pound) to the hourly quota. The practitioners who are 45 years of age and younger must wrap ten jin of candy every hour. The practitioners who are 46 to 60 years of age must wrap nine jin. Practitioners who are 61 to 65 years of age must wrap 6 jin, and practitioners who are 66 years of age or older must wrap five jin per hour. If one misses the quota by nine hours in one week, she is forced to sit upright for two hours every night as punishment if she is over 60 years old, forced to stand for two hours every night if she’s younger than 60 years old. The guards also oversee monthly inventory and production records on the 24th of each month, and the bottom three producers on the amount finished list, even though they have finished their quota, have their credit reduced and are forced to write “self-criticisms.”
The candy wrapping in the Fourth Division is kept hidden from the outside. The candy barrel and the board used for the candy wrapping are filthy and covered with mildew. Mouse excrement is often seen mixed in with the candies. When the higher authorities come to inspect, the camp guards hide all the candies behind the last two doors on the bottom floor in the shop for making the fittings for electric wiring installation. It was said that the National Labor Bureau was conducting a comprehensive inspection which lasted twenty days in August, 2009. The division took away all the candy barrels and candy wrappers on August 16. Hu Xiaoyan, Party secretary in the camp, personally threatened over 200 laborers, “If the authorities ask what kind of work you do in the factory, you are to say that you are making fittings and paper cartons. Don’t say candy wrapping. Whoever says ‘candy wrapping’ will suffer the consequences of having your term extended.”
The following are the types of candies wrapped in the labor camp and their names and manufacturer. Please let people know they should not buy products made by the Yaxuan Corporation.

A Tax Official's Change after Practicing Falun Gong (Falun Dafa)

A Tax Official's Extreme Change after Practicing Falun Dafa

May 27, 2012 | By Xue Zhongmei, a Falun Dafa practitioner from China
(Minghui.org) I used to suffer from all kinds of ailments and could not take care of my daily needs. Because of a slipped disc, I could not walk normally but could only move haltingly, step by step. I used a customized steel belt to support my back. In addition, I was afraid of opening my eyes when I was outside. On bad days I feared getting cold and covered up with a quilt, and I kept the windows closed at night. Whenever I was hospitalized, I would be in the hospital for at least three months. Because of so many injections, the nurses could not find another place for an injection, evem in my buttocks. I took a lot of Chinese and Western medicines. In addition to medication, I went to temples to worship Buddha, kowtow, and burn incense in an attempt to cure my ailments, but all of this was in vain.
In 1998, the husband of an acquaintance said to me, “Practice Falun Gong! My wife is free of back pain after practicing Falun Gong. She now even gives postpartum care at home!” At first I did not believe it because I had tried every possible approach, including begging Buddha, but none of them could cure my illnesses. One day while I was lying in bed, I thought, “I have exhausted all methods but my ailments have not disappeared, so why not practice Falun Gong!” My friend’s husband then gave me the audiotapes of the lectures given by Master Li Hongzhi. I quietly listened to the lectures one by one, and wondered why the principles were so different from my views of life.
I am a national tax official. Before suffering from illness, I was aggressive and had a strong competitive mentality. Since my post granted me power, I developed a very greedy personality. Sometimes I would tell my husband, “Bring the cardboard boxes from your office back home. We can make money by selling them for two cents each!” I was harsh on taxpayers. For example, I went to a flour mill owned by taxpayers to ask for free flour, and then I would drag two big bags on my small bicycle back home. The potholed dirt road could not keep me from doing this, back and forth, several times a day. If I could not consume all of the flour I just sold it for profit. I could not sleep well when festival seasons came because I would rack my brain to think how to take more advantage of taxpayers. As for gifts given by taxpayers, I would accept them all and I took them for granted. I would sometimes ask for more if I thought the gifts were too small. In addition, I would cause trouble for taxpayers by finding fault with their tax forms on purpose, and I did not approve their tax reports until they gave me more bribes.
I did not pay a penny for my meals when I went out to restaurants owned by taxpayers. Sometimes I even ordered take-out dishes from home and did not pay for them, either. I knew that I would be nothing to taxpayers if I were dismissed from my post, so I therefore wanted to make as much side profit as I could as long as I was in my position. Every time I went to big enterprises for audits, I would eat and drink as much as possible, and what’s more, I would bring things back home until it was too heavy for me to carry. Sometimes taxpayers wanted to pay for my shopping in stores because they knew that I was the one who would decide how much they needed to pay for their taxes. The only loser was the tax revenue. Such was my miserable life, and by vying and competing for personal gain day after day, I ended up with all kinds of physical ailments.
I blamed myself while listening to the lectures by Master. Since then, I have completely changed my view of life. Through practicing Falun Gong, I am free of illness and my entire body is light. Once, before the Moon Festival, my department scheduled an audit of taxpayer’s tax forms. A lot of them wanted to give me shopping cards in exchange for less taxes if I committed fraud on their forms, but I turned all of them down. Some taxpayers invited me out for meals, but I replied, “You can feed your whole family on only five yuan; however, if you buy me a meal in a restaurant it would cost you more than 85 yuan. It is too expensive to have a meal in a restaurant.” Since then, I do not have meals at the expense of taxpayers. One time, there was something wrong with a taxpayer’s form. In the evening the taxpayer stopped by and wanted to give me a bribe. I refused to take it, but he did not want to leave my home. I pointed to the Chinese character “De” (virtue) on the wall and said, “The principles of Falun Gong which I practice are Zhen-Shan-Ren (Truthfulness-Compassion-Forbearance). The character De on the wall is a very important moral virtue for people to follow. If I take your gift I will lose De. I will take your interests into consideration only if it is not against national policy.” He smiled and left. Later he told me that his uncle also practiced Falun Gong, and he knew that practitioners were all good people.
Some taxpayers wanted to establish further relations with me and asked for my personal phone number, but I refused and said, “Please call me at my office number.” My colleagues have several apartments and new cars, but I am not jealous and conduct myself according the principles of Zhen-Shan-Ren. During one Lunar New Year, a taxpayer wanted to give me something as a gift and asked for my address, but I did not give it out to him. He said, “You know, we are relatives. The grandson of the second son of the son-in-law of the second daughter of your aunt on your mother’s side is my nephew, so we are true relatives.” I laughed, as I knew that what he valued more was the power I had from my post.
Though the Chinese Communist Party (CCP) regime continues to persecute Falun Gong, to corrupt, abuse power to damage the national interest, and to fatten its purse at the expense of the public, I still take the interests of my country as a whole into consideration. I remember what Master said, “If officials are unselfish, the state will not be corrupt.” (“Pacify the External by Cultivating the Internal,” Essentials for Further Advancement)
One of my colleagues was entrusted by us to manage our social security fees. However he often used the money for his own use, which annoyed everyone. Since I am the first one in the office and the last one to leave every day, and I clean up the office and work very diligently, do any assignment the boss gives, and no longer compete for personal gain, my colleagues entrusted me to manage the social security fees. I publish a detailed list of the fees once a week and let them know clearly the exact cash flow, down to the last penny. My colleagues laugh in relief and some have said, “We trust you and will not question you even if you do not post the details for a year.” My post is granted first by an audit by the higher-level authorities every year. The director general of my department has praised me publicly many times in assemblies: “If every staff behaved like [me], the performance of our unit would be well improved.”
After practicing Falun Gong, I no longer make a side profit from taxpayers. My work is praised as “Qing Shui Ya Men” (a work unit which has no outside income). Because I practice Falun Dafa, I am now like a completely different person.
